Welcome to Fishbrain.ai (“Fishbrain,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of our website, products, and services.
By using Fishbrain, you agree to these Terms. If you do not agree, please discontinue use.

1. Service Description

Fishbrain provides a scoped, persistent memory layer for artificial intelligence models.
Our platform allows you to:

  • Store and organize your own knowledge in domain/topic hierarchies
  • Automatically extract insights from conversations using our Reflection Engine
  • Inject contextual memories into AI prompts transparently
  • Integrate with multiple AI providers (OpenAI, Anthropic, Google, xAI, and others)
  • Maintain full control over your data — encrypted, isolated, and never sold

Fishbrain acts as your private cognitive workspace, not a data collection platform.

2. Acceptance of Terms

By creating an account or using Fishbrain, you confirm that you are at least 18 years old and have the authority to enter this agreement.
We reserve the right to refuse or suspend service for users who violate these Terms or applicable laws.

3. User Accounts

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
Please notify us immediately of any unauthorized access.
We are not liable for loss or damage resulting from your failure to safeguard your account.

4. User Obligations and Content Responsibility

You are solely responsible for the content you upload or store through Fishbrain.
You agree that:

  • You own or have permission to use your uploaded content
  • Your content does not infringe on others’ rights
  • You will comply with all applicable laws and regulations
  • You will not upload sensitive personal data (e.g., SSNs, credit card numbers) unless explicitly permitted
  • You will not use Fishbrain for illegal or harmful purposes

Your data remains yours. Fishbrain only processes it to operate features you initiate.

5. Prohibited Use

You agree not to:

  • Violate any law or regulation
  • Upload malicious code or attempt to disrupt our systems
  • Harass, exploit, or abuse other users
  • Access or probe any part of the system without authorization
  • Reverse-engineer or attempt to derive our source code
  • Scrape or extract data without permission
  • Use Fishbrain to build or train a competing product

6. Intellectual Property Rights

Your Content:
You retain full ownership of the content you create.
By storing it on Fishbrain, you grant us a limited, revocable license to process and display it solely for the purpose of providing our services.

Fishbrain IP:
All code, algorithms, design, branding, and documentation remain our intellectual property.
You may not copy, modify, or redistribute these materials without written consent.

Feedback:
Any suggestions or improvements you provide may be used freely, without compensation or obligation.

7. Data Privacy and Security

Your use of Fishbrain is also governed by our Privacy Policy.
We use industry-standard encryption, scoped access controls, and Supabase’s secure infrastructure.

Fishbrain never sells, shares, or trains on your data.
Your memories, conversations, and uploads are private to your account unless you explicitly choose to share them.
No human at Fishbrain has routine access to your content.

While we take security seriously, no system is invulnerable.
You acknowledge that data breaches, while unlikely, may occur and agree that Fishbrain’s liability is limited as described below.

8. Limitation of Liability

Fishbrain is provided “AS IS” and “AS AVAILABLE.”
We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law:

  • Fishbrain’s total liability for any claim shall not exceed the amount you paid in the preceding 12 months (or $100 if unpaid).
  • We are not liable for indirect, incidental, or consequential damages (e.g., lost profits or data).

9. Indemnification

You agree to indemnify and hold Fishbrain, its officers, employees, and agents harmless from any claim arising out of:

  • Your violation of these Terms
  • Your use of the service
  • The content you upload
  • Your infringement of intellectual property or privacy rights

10. Service Changes and Termination

We may modify, suspend, or discontinue any part of Fishbrain at any time, with or without notice.
If you violate these Terms or applicable laws, we may terminate your access.
Upon termination, your right to use Fishbrain ceases immediately, and we may delete your stored data according to our Privacy Policy.

11. Third-Party Services and Links

Fishbrain integrates with third-party AI providers (OpenAI, Anthropic, Google, xAI).
Their terms and privacy policies govern your interactions with them.
We are not responsible for external services or their data practices.

12. Payment and Billing

Fishbrain offers paid subscription plans as described on our Pricing page. These plans may include promotional free or discounted trial periods.

By starting a paid subscription, you agree to pay the fees associated with your selected plan. Unless otherwise stated, subscriptions renew automatically until you cancel.

Any changes to base subscription pricing will be announced with at least 30 days' notice.

You are responsible for any taxes or third-party provider fees (for example, model usage billed directly by OpenAI, Anthropic, Google, xAI, or others).

13. Dispute Resolution

These Terms are governed by the laws of the United States.
Any dispute shall be resolved exclusively in U.S. federal or state courts.
Both parties waive any right to class action or jury trial to the extent permitted by law.

14. Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions shall remain valid and in effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fishbrain.
They supersede all prior understandings regarding your use of the service.
